Luevano To Appeal Court Decision That Removed Him From Ballot

ALBUQUERQUE, N.M. — West Side Republican Johnny Luevano says he will appeal last week’s District Court decision that led to Bernalillo County Clerk Maggie Toulouse Oliver removing him from the ballot to run for the House District 16 seat currently held by Democrat Antonio “Moe” Maestas.

At a press conference Monday morning in his home on Bluffside, Luevano said voters in the district deserve to have someone represent them.

Maestas challenged Luevano’s eligibility to run claiming he was not legally living in the newly built home in the district on the date required by law. The ruling last week by Judge Alan Malott supported that position and left Maestas as the only candidate running to represent the district.

Luevano, who retired from the U.S. Marine Corps in August, countered that he was eligible to claim the Bluffside address under a federal law that allows service personnel to establish a residence.

Luevano said he will ask the State Court of Appeals to expedite a decision in his case.
