UPDATED: ABQ Man Pleads Guilty to Child Porn Charges

Antonio Gallegos, 47, of Albuquerque, pleaded guilty in federal court Tuesday to distribution and attempted distribution of child pornography in a plea agreement with the U.S. Attorney’s Office, federal prosecutors said in a news release.

Gallegos is facing a maximum penalty of between five and 20 years in prison followed by a lifetime of supervised release at his sentencing, at a date still to be set. He also will be required to register as a sex offender.

In his plea agreement, Gallegos admitted that from Aug. 6, 2011, through March 6, 2012, he knowingly distributed and attempted to distribute child pornography through a peer-to-peer file sharing program, the release said.

The New Mexico Internet Crimes Against Children Task Force executed a search warrant at Gallegos’ West Side Albuquerque residence on March 6 following a New Mexico State Police investigation that began in September 2011, prosecutors said.

A forensic examination of Gallegos’ computer and computer-related media revealed thousands of images and videos of child pornography, including 20 images of 15 children who have been identified as child pornography victims who have been rescued, according to the release.

Gallegos has been in custody since his arrest on April 30 and will remain in custody until his sentencing hearing.

Albuquerque resident Antonio Gallegos, 47, appeared in federal court Tuesday morning to face charges of distribution, receipt and possession of child pornography, the U.S. Attorney’s Office said in a news release.

Gallegos was arrested without incident on Monday by the Federal Bureau of Investigation and was being held pending a preliminary hearing and detention hearing scheduled today, the release said.

According to the criminal complaint, Gallegos allegedly distributed, received and possessed child pornography from Aug. 7, 2011 through March 6, 2012 in Bernalillo County, federal prosecutors said.

On March 6, the FBI and New Mexico State Police executed a federal search warrant at Gallegos’ Albuquerque residence and seized computer media, electronic media and videotapes, according to the release.

If convicted of either distribution or receipt of child pornography he faces not less than five years or more than 20 years in prison, and the penalty for possession of child pornography is up to 10 years in prison, prosecutors said.
