Man accused of rape near religious site

SANTA FE – A Santa Fe man has been arrested on allegations that he raped a 16-year-old girl near the Cross of the Martyrs, the religious monument overlooking downtown Santa Fe that is dedicated to priests and others who died in the 1680 Pueblo Revolt.

Leonard Quintana, 21, was arrested on a warrant on June 12, according to Santa Fe Police spokeswoman Celina Westervelt. She said he told police he had been friends with the girl for years and that the sex was consensual.

He faces a preliminary hearing June 26 in Santa Fe County Magistrate Court on charges of criminal sexual penetration of a child between the ages of 13 and 18, three charges of contributing to the delinquency of a minor, and two charges of giving alcoholic beverages to a minor, according to a court records database.

A search warrant affidavit, which sought a sample of Quintana’s DNA, alleges the following:

The girl told police she and her brother agreed to meet Quintana on the Plaza on June 7, and he arrived with a promised bottle of Jack Daniels whiskey for them to share. The three walked toward the Cross, crossed a fence and drank the whiskey.

The girl said her brother got extremely drunk and was acting belligerently. She alleged that Quintana offered him some marijuana to calm him down. While her brother smoked the drug out of a glass pipe, Quintana tried to kiss the girl but she pulled away, the affidavit said.

The girl said her brother fell asleep, and Quintana asked her if she wanted to keep drinking. She agreed and eventually blacked out. She told police she next remembers being propped up against a fence, partially unclothed, with Quintana assaulting her.

Her brother told officers that he woke up and saw his sister and Quintana. He said he took a picture with his cellphone camera and then ran and slammed his body into both of theirs. He said he yelled, “What’s going on?”

The brother said he was so upset that he ran to his house. The girl said she put her clothes on and ran away.

The girl underwent a sexual assault examination at Christus St. Vincent Regional Medical Center, which found evidence of penetration, the document said.

Quintana has an open case in state District Court in Santa Fe from a different incident charging him with felony distribution or possession of marijuana or synthetic cannabinoids and felony contributing to the delinquency of a minor.
