New Mexico Land Commissioner Ray Powell is going to court to address a massive tire dump that stretches through a remote arroyo in northeastern New Mexico.
His office filed a complaint Monday in state District Court, alleging breach of lease by Troy and Harold Daniels.
The tires had been characterized by the former administration as an erosion control project. Powell calls it a misuse of state trust land.
The tires fill an arroyo near the community of Wagon Mound. Powell’s office estimates that 150,000 tires have been dumped in the arroyo.
Powell said he has authority to terminate any existing lease that is obtained wrongfully or is causing damage to trust land. The office contends the dumping of tires on land leased for agricultural purposes was done without permission.
