ALBUQUERQUE, N.M. — A Gallup restaurant owner won $130,000 after he sued the city for damage to his restaurant, but according to the Albuquerque Police Department, the restaurateur’s lawyer then pocketed the check.
Attorney Cody Kelley now faces embezzlement charges, and police are looking for the public’s help in finding him.
Anyone with information about Kelley’s whereabouts is asked to call 242-COPS.
Police said the victim came to them saying $130,000 had been awarded to him for restaurant repairs, but his attorney never gave him the money.
When police investigated, they found that Kelley had deposited the checks into his own checking account and had spent all the money in a three-month period, according to APD.
