ALBUQUERQUE, N.M. — A pregnant woman in possession of cocaine who was arrested on Wednesday was on probation for the drug-related death of her two-year-old in 2008.
Rose Garcia and Joe Martinez, both 30, were arrested at a Sonic in Española, according to a news release from the Department of Corrections. Garcia, who is pregnant, was found with six grams of cocaine. The pair had two toddlers, ages 1 and 2, in the backseat of the truck.
On May 7 or 8, 2008, Garcia and Martinez’s two-year-old ingested cocaine and died as a result. The couple pleaded no contest to child abuse in March 2010 and were given deferred sentences and placed on three years of probation, the release said.
The children in the backseat of the truck on Wednesday were placed in custody of CYFD. Garcia and Martinez were booked into the Rio Arriba County Jail.
Martinez is facing charges of possession with intent to distribute and child abuse. Garcia was charged with a probation violation, the release said.

Associated Press — ESPANOLA — Authorities say a pregnant mother, who’s already on probation for the death of her two-year-old child, is facing drug charges after police found cocaine on her and two kids in her car.
KOAT-TV reports that probation and parole officers arrested Rose Garcia and her boyfriend, Joe Martinez, at a Sonic in Espanola on Wednesday.
Police said the pair has six grams of cocaine on them and two kids in her car. Investigators said they believed the two were dealing cocaine.
It was unclear if either had attorneys.
