Judge sets Elton Richard free

 Judge Albert Pat Murdoch on Friday reduced the two-year sentence of Elton John Richard to four months Friday.

Richard  pleaded no contest to manslaughter  in a case in which chased down 34-year-old Daniel Romero with a gun after catching Romero breaking into his car back in 2004.

Because he has served the time already, and under an agreement with the warden, Richard will be a free man after court processing.

 


Elton John Richard is scheduled to go back before Judge  Albert Pat Murdoch Friday morning on a motion to reconsider the sentence.

Richard  pleaded no contest to manslaughter  in a case in which chased down 34-year-old Daniel Romero with a gun after catching Romero breaking into his car back in 2004.

Murdoch sentenced him to two years in prison in what Murdoch said was one of the most difficult decisions he has made in 22 years on the bench.

The case led to public outcry and a plea to Murdoch from Gov. Bill Richardson to reconsider.
