A mistrial was declared Tuesday when a jury was unable to agree on whether former Albuquerque Police Department officer Timothy Chavez is guilty of raping a 14-year-old girl in 2005. After briefly speaking with jurors, 13th Judicial District Judge William Sanchez said they had voted 11 to one for acquittal on every count but one, and 10 to two on that one. The jury had deliberated for nearly three days. Chavez had been charged with criminal sexual penetration, criminal sexual conduct and other crimes after the girl, whom he met on a telephone dating service, said Chavez raped her at her home. Chavez testified he thought the girl was 18 and that the sex was consensual. Prosecutors said it would be up to Attorney General Gary King whether to try the case again.
