State district judge quashes restraining order against late-night talk show host.

State District Judge Daniel Sanchez has lifted the order he earlier granted Colleen Nestler, who accused comic David Letterman of using "code" to communicate his wish to marry her. Attorneys for Letterman had asked the judge to quash the order he issued Dec. 15 as being frivolous and without merit. See The Associated Press story here.


6:40am -- Dave's Not Here: But his attorneys are expected to be in court today in Santa Fe.

State District Judge Daniel Sanchez will hear arguments today why a restraining order the judge granted a Santa Fe woman on Dec. 15 against late-night talk show host David Letterman should not be quashed.

Colleen Nestler had claimed Letterman was disrupting her life by communicating with her through televised coded messages, and Sanchez put a temporary clamp on any contact with Nestler by the television star. See the Albuquerque Journal stories here and here.

Letterman's attorneys call the claim "absurd and frivolous" -- imagine that! And now they're seeking a permanent injunction against Nestler to keep her from filing such claims -- or at the very least get an attorney to represent her.

Sanchez, who originally set the hearing on his TRO for Jan. 12, agreed to move the hearing up to today.
