Woman told police she was assaulted twice while sleeping at the man's apartment.
Andres Martinez, 23, was arrested Thursday by New Mexico State Police, accused of sexually assaulting his estranged wife twice as the woman slept in his Alamogordo apartment, the Alamogordo Daily News reported. Martinez is charged with two counts of criminal sexual penetration in connection with events that allegedly occurred on the night of Jan. 31, police told the Daily News. "The victim reported that Martinez had asked her to stay at his apartment that night," State Police Lt. Rick Anglada told the Daily News. "She told officers that Martinez had made advances toward her and that she had refused his advances and request for sex." Anglada said the woman, who is 20 years old, fell asleep but was awakened by Martinez sexually assaulting her, and after she pushed him away, she fell asleep, only to find him assaulting her again, the Daily News said. During their investigation, State Police got a warrant to search Martinez's apartment and questioned him, the paper reported. After his arrest on Thursday, Martinez was booked into the Otero County Detention Center where he is being held on a $35,000 bond, the Daily News said.
