Jury deadlocked last August over 2006 stabbing incident in Las Cruces.

A new trial began Thursday for former State Police Officer Nicholas Zepeda, who turns 25 today and is accused of stabbing then-23-year-old Daniel Reyes three times in a Las Cruces apartment on Aug. 9, 2006, the Las Cruces Sun-News reported.

Zepeda's first trial on a single count of aggravated battery ended in a mistrial last August when the jury couldn't reach a verdict after five hours of deliberation, the Sun-News said.

The Las Cruces native had been a State Police officer for 20 months and was stationed in Espanola when he was in Las Cruces to attend a training class when the alleged incident occurred, the paper said.

According to reports at the time, Zepeda and Reyes were involved in an altercation at a Las Cruces bar, and the fight continued at an apartment complex where Zepeda was struck on the head with a beer bottle.

Zepeda then allegedly stabbed Reyes three times, the Sun-News reported.

The former officer took the stand in his retrial on Thursday, and the trial could conclude today, according to the Sun-News.
