Picacho Hills man, 87, was never charged in March 28 shooting death.
Drew Waldron, the 87-year-old man who police thought shot and killed his wife Theria Waldron, also 87, at their upscale Picacho Hills home on March 28, has died of Alzheimer's disease, District Attorney Susana Martinez told the Las Cruces Sun-News. Waldron died at a secure medical facility, and the man's family notified Martinez of his death on May 26, the Sun-News reported. Martinez never charged Drew Waldron because of his mental-health history, which she obtained with the consent of his family, the paper said. Waldron, who did not remember shooting his wife, could not "form the intent necessary to be charged with a crime," Martinez told the Sun-News.

Drew Waldron is undergoing a psychiatric evaluation at a Las Cruces medical facility and is considered a person of interest in the death of his wife, Theria Waldron, who was shot in the head some time early last Friday in the couple's Picacho Hills home, west of Las Cruces, the Las Cruces Sun-News reported. The Waldrons, whose exact ages aren't known, are said to be in their 80s, and Drew Waldron reportedly suffers from Alzheimer's disease, the Sun-News said. Drew Waldron called Dona Ana County emergency dispatchers around 5:30 last Friday morning to report his wife missing, but when deputies arrived they found Theria Waldron's body in the master bedroom of their upscale home, the paper reported. Sheriff's investigators have said Drew Waldron may or may not be charged in his wife's death because of his mental health, and the decision will be made by Dona Ana County District Attorney Susana Martinez, the Sun-News said. Martinez said she will decide after reviewing Drew Waldron's medical records and physical evidence from the Waldrons' home, the paper reported. The Waldrons were described by neighbors as a friendly, sociable couple who had lived in the home since the late 1980s, the Sun-News said.
