Federal prosecutors say suspect used another's credit card, ID to buy a Lexus.
Boynton N. Clune III, a 36-year-old from Albuquerque, has pleaded not guilty to four federal charges at an arraignment in Billings, Mont., according to the Billings (Mont.) Gazette. Clune was indicted on one count of access device fraud, bank fraud and two counts of aggravated identity theft, and if convicted faces a maximum of 30 years in prison, a $1 million fine on the bank fraud charge and a mandatory two-year enhancement of the identity theft counts, according to the Gazette. Federal prosecutors say that between July 2005 and February 2006, Clune used the identity and credit card of another man to get a loan to buy a Lexus, the Gazette reported. U.S. Magistrate Judge Carolyn Ostby in Billings continued Clune's release without bond pending trial, the paper said. Chief U.S. District Judge Richard Cebull will hear the case, according to the Gazette.
