Teacher who allegedly grabbed student last week no longer with school district.

Howard Billy Jr., 39, of Alamo is charged with one count of aggravated battery, a third-degree felony, for allegedly grabbing a 14-year-old student and slamming him into a wall last week at Magdalena mid-high school where he was substitute teaching, El Defensor Chieftain reported.

"He is no longer employed here, period, in any capacity," Magdalena Schools Superintendent Mike Chambers told El Defensor Chieftain.

Billy had issued the boy a referral on May 5 for being disruptive in class and the boy was given a two-day suspension, the paper reported.

The following day, according to a criminal complaint, Billy followed the boy into a bathroom during the school's second period and confronted him, and a witness reported seeing Billy with his hands around the teenager's neck, then slamming him against a wall, El Defensor Chieftain said.

The teen reportedly suffered a mild concussion in the incident, according to the complaint.

The complaint said Billy told school Principal Regina Lane that the teenager "needed to know who was boss," and added, "Sometimes I don't know how strong I am."

Billy, who worked as a substitute in various classes at Magdalena schools, is scheduled to appear before Magistrate Jim Naranjo at 1 p.m. May 28, El Defensor Chieftain reported.
