Police looking at 20-year-old for June 21 shooting of ice-cream seller in Downtown ABQ.

Albuquerque police say they have a suspect in custody and are questioning him in connection with the June 21 shooting of 44-year-old ice cream vendor Jose Rivera near 11th and Coal SW, KOB-TV is reporting.

A witness picked out 20-year-old Matthew Barraza from a lineup as the person seen with a gun shortly after Rivera was shot, but police say they still don't have enough evidence to charge Barraza in the shooting, KOB-TV reported.

But Barraza is now in custody on an alleged parole violation, police told Eyewitness News 4 reported.

Barraza allegedly assaulted a police officer in early June while out on bail awaiting trial in a 2003 murder case, and detectives also are looking into Barraza's possible involvement with some armed robberies in the days following Rivera's death, KOB-TV said.

Barraza was just 16 years old when he and two others were accused of killing a man at the Red Roof Inn on the West Side, but that case has been stalled because a key witness died of cancer, according to Eyewitness News 4. 


10:10am 6/24/08 -- Suspects Described in Vendor's Shooting: Three were in green Mitsubishi Galant when ice-cream man was shot Saturday.

Albuquerque police are looking for three people they think were involved in the fatal shooting of an ice cream vendor near 11th and Coal SW on Saturday, KOB-TV reported.

Police say the suspects were driving a green mid-1990s Mitsubishi Galant with a faded roof and top, when one of the people got out of the car and shot 44-year-old Jose Rivera once in the chest, according to KOB-TV.

All three suspects are described as Hispanic in their late teens, the station reported.

The driver is a female, about 5 feet 3 inches tall, weighing 120 pounds, and was wearing a pink tank top at the time of the shooting, police tell KOB-TV.

One of the male suspects is about 5 feet 6 inches tall and was wearing a black and blue jersey, while the second male is 5 feet 6 inches tall, weighs about 150 pounds, has a shaved head and was wearing a black and white plaid shirt, police told Eyewitness News 4.

Police said they believe that the victim, a Mexican national, was homeless.

No money was found on Rivera and his ice-cream cart contained only frozen treats, police told KOB-TV.


5:30am -- Police ID Dead Ice-Cream Man: ABQ police have identified the ice cream vendor shot and killed Saturday.

Police say Jose Rivera, 44, was pushing his ice cream cart near 11th and Coal SW when someone got out of a car and shot him. Rivera was a Mexican national and transient, Albuquerque Police Department spokesman John Walsh said.

Police are looking for a dark green, mid-1990s Mitsubishi Galant in connection with the shooting.
