EEOC sues firm that operates several McDonald's restaurants in the ABQ area.
The U.S. Equal Employment Opportunity Commission anounced Monday it had filed a sex discrimination and retaliation lawsuit against LPG Enterprises Inc., which owns and operates several McDonald's restaurants in and around Albuquerque, the EEOC said in a news release. The EEOC claims that an LPG manager subjected Alejandro Jasso and a class of females to egregious sexual harassment -- including physical assault -- as well as a barrage of sexual comments and innuendo that created a hostile work environment, the release said. The complaint also alleges that Jasso suffered retaliation because she opposed the manager's unwelcome conduct and that she was forced to resign because of harassment, retaliation and the employer's failure to provide appropriate relief, according to the release. The suit, filed in U.S. District Court in Albuquerque, also seeks relief for what it calls a class of females who were allegedly subject to sexual harassment by the same manager, the release said. "Our investigation revealed that LPG's former manager was permitted to use the workplace as his playground for egregious unlawful conduct," EEOC Phoenix District Director Chester V. Bailey said in the release. "Employers have an important responsibility to protect their employees from harassment in the workplace. In this case, the employer failed to do so and will now have to answer for its conduct in court." Larry and Pearlene Garcia of LPG Enterprises, which operates 12 McDonald's restaurants, including the one at 2305 Central SW in Albuquerque, did not return phone calls for comment.
