Man arrested on suspicion of his fourth DWI charge in stolen Jeep
An Albuquerque man who allegedly racked up his fourth DWI charge in a stolen vehicle early Sunday remained in jail on Tuesday, according to a criminal complaint. Herman R. Garcia, 45, is charged with aggravated DWI (fourth or subsequent), receiving or transferring a stolen vehicle, aggravated fleeing from a police officer, vehicle accident causing great bodily injury. An Albuquerque police officer saw a Jeep about 4:57 a.m. Sunday swerving as it headed east on Zuni SE near Virginia SE. The Jeep later made a sudden U-turn near Wyoming and headed west on Zuni, according to the complaint. The driver of the Jeep, later identified as Garcia, saw the police officer and the Jeep accelerated at a high rate of speed. The Jeep went airborne as it crossed Wyoming and Zuni, ran a red light, and swerved across traffic lanes. The Jeep collided into a truck pushing it into a cinder-block wall. The Jeep spun put of control and later came to a rest, according to the complaint. Garcia sustained lacerations to his head and became belligerent with the officer. He was placed in handcuffs and was seated on a curb. Garcia had a strong odor of an alcoholic beverage coming from him, according to the complaint. The Jeep that Garcia was driving had been reported stolen on Saturday morning. The female driver of the truck was taken to a hospital with numerous broken bones and internal injuries, according to the complaint. The woman's injuries were non life-threatening, Albuquerque Police Department spokeswoman Nadine Hamby said. Alcohol is possibly a factor with both drivers, Hamby said. The APD investigation is ongoing. The case will later be forwarded to the District Attorney's Office.
