A 72-year-old man is accused of whipping out a gun during a Del Farrell Homeowners Association meeting
About 7:30 p.m. Thursday, police were called to the James Dwyer Police Substation near Montgomery and Tramway, according to a criminal complaint filed in Bernalillo County Metropolitan Court.
The substation was being used for the Del Farrell Homeowners Association meeting.
While the meeting was in session, the complaint states, "Patrick McHale told Jon Dienlin to stop his side conversation to get back on the agenda. Jon told Patrick to shut up."
After arguing, Dienlin, who was sitting in front of McHale, "stood up and turned around pointing a small silver handgun at Patrick's chest," the complaint states. "Jon told Patrick, 'I will kill you,'" the complaint states.
McHale feared for his life and thought he was going to be shot, he told police.
McHale backed up and stepped to the side to get away from Dienlin, who left shortly thereafter, according to the complaint.
Many of the 25 people attending the meeting began to leave.
Dienlin's wife told police that her husband did remove a gun from his pocket but did not point it at McHale. Her husband said, "I don't have to take this, and left," she told police.
A different witness said Dienlin stood up, removed a gun from his pocket and "aimed the gun at Patrick."
Officers later found Dienlin at his home and asked him to step outside, which he did. Dienlin told police he had just taken nitroglycerin, that he was a Marine and he had post-traumatic stress disorder.
"He said he blacked out and does not know anything that happened the last two hours," according to the complaint.
He was taken to the VA Hospital, where an officer sat with him.
Dienlin told an officer he threw the gun somewhere near the substation, according to the complaint. The gun had not been found.
Dienlin was booked into the Metropolitan Detention Center on Friday. He was charged with aggravated assault with a deadly weapon and tampering with evidence. His bond was initially set at $50,000.
