The National Education Association of New Mexico on Tuesday unsealed a lawsuit over lost state investments in hedge funds run by convicted con-man Bernard Madoff.

The State Investment Council and Educational Retirement Fund lost approximately $25 million of the $180 million the agencies invested with a Texas firm that in turn invested some of the money with Madoff controlled firms.

The lawsuit is based on the same legal theory as the one filed on behalf of former Educational Retirment Board chief investment officer Frank Foy.

Former Chief Investment Officer for the Educational Retirement Board, Frank Foy has filed a second lawsuit alleging political contributions determined which companies received state investments the ERB and State Investment Council.

The 74-page complaint names almost 40 companies and more than 25 individuals as defendants in the lawsuit brought under the state's Fraud Against Taxpayers Act which allows citizens to sue on behalf of the state.

Many of the companies and individuals named in the lawsuit have come up in press accounts of a New York pension fund scandal which has numerous connections to New Mexico.

Victor Marshall, Foy's attorney, has scheduled a press conference for 10:30 a.m. today. Journal Investigative Reporter Mike Gallagher is at the press conference and will have a full report in Wednesday's Journal.
