State  mental health officials have determined that a Las Cruces man accused of fatally shooting his mother is unfit to stand trial.

An order filed in court this week states that 26-year-old Justin Quintana was found to be incompetent after an evaluation at the New Mexico Behavioral Health Institute in Las Vegas. Quintana's mother was New Mexico State Police officer Susan Kuchma, who was off duty at the time of the shotting.

According to court records, Quintana, in the days prior to his mother's death, broke into Kuchma's home and stole a handgun that he used to shoot his mother
