A Massachusetts-based company has sued to stop the state Department of Transportation and the Mid-Region Council of Governments from using the “Rail Runner” name, which it uses for the state-owned commuter train, and for damages related to "trademark infringement."
“RailRunner N.A. has consistently been interested in reaching a settlement,” said Mark Metzger, a spokesman for the company that deals with truck and rail transport. “But the reason for the filing of this lawsuit is that those efforts have been rebuffed.” According to the federal lawsuit filed last month in Boston, RailRunner N.A. Inc., operates under the RailRunner name. A trademark registration was issued for the mark in 2005 for its “railway bogeys,” and it owns a registration for the mark for other transportation equipment, the lawsuit states.
