Discount Retailer Settles Data Dispute

      The N.M. Attorney General's Office announced Tuesday that a national settlement has been reached with TJX Cos. that resolves an AG's investigation into the company's data breach that placed thousands of consumers' personal data at risk.
       Retail stores operating under the TJX in New Mexico are TJ Maxx and Marshalls.
       “Consumers in New Mexico may have been exposed to identity theft and other problems as a result of the security breach,” Attorney General Gary King said in a statement. “We are pleased that TJX is cooperating and taking steps to improve security so that this will not happen again.”
       The company agreed to what is called an “assurance of discontinuance,” brokered by 41 state attorneys general. TJX must implement an information security program designed to guard against future intrusions or unauthorized disclosures.
       The coalition of attorneys general investigated TJX's data security policies and procedures after a reported breach in 2007, finding a number of vulnerabilities and flaws.
       TJX has agreed to pay $9.75 million to the states and to implement and maintain a comprehensive information security program to address weaknesses in TJX's computer security systems in place at the time of the breach. Of that money, $5.5 million will be used for data protection and consumer protection efforts by the states, and $1.75 million will reimburse the costs and fees of the investigation. The remaining $2.5 million of the settlement will fund a Data Security Trust Fund to be used by the state attorneys general to advance enforcement efforts.
       Under the terms of the settlement, New Mexico will receive more than $23,000 to aid consumer protection enforcement and efforts to protect consumers' personally identifiable information.
