Journal and Wire Reports Objections Filed In Emissions Fight Sandia Sci-Tech Park Wins Award
An objection filed in the state Environment Department's cap-and-trade proceeding alleging the Environmental Improvement Board hasn't followed a state law intended to protect small businesses was also filed in the pending New Energy Economy case for a statewide cap on emissions.
The objections were filed last week by Tri-State Generation and Transmission Association. The board, which might wrap up the cap-and-trade hearing this week, resumes the NEE hearing on Monday.
Tri-State contends state rulemaking bodies are required by law to notify the Small Business Regulatory Advisory Commission of proposed regulations. The commission may then review the rules to determine if they place unnecessary burdens on small businesses and make recommendations to limit the impacts. Attorney Louis Rose of Montgomery & Andrews, which represents Tri-State, said while NMED and NEE provided notice, the board, as required by law, did not. NEE attorney Bruce Frederick said the NEE would have no impact on small businesses and viewed the Tri-State action as a delaying tactic.
