The court in Las Cruces has recessed for the day, according to a spokeswoman for the Office of the District Attorney.
The state did not rest its case, as was expected, and plans to call additional witnesses on Tuesday, when court resumes.
8:13 a.m. – LAS CRUCES (AP) — The prosecution is expected to rest in another murder trial for a man already facing the death penalty for killing a Bernalillo County sheriff’s deputy.
Prosecutors said they will likely rest their case Friday in Michael Astorga’s trial over the death of an Albuquerque man. Astorga is accused of killing 27-year-old Candido Martinez over a car back in 2005.
That trial was ordered moved to Las Cruces after a judge ruled Astorga wouldn’t get a fair trial in Albuquerque.
Astorga’s lawyers said they expect Astorga to testify sometime during the defense phase.
Astorga was convicted in the 2006 killing of Deputy James McGrane Jr. and faces the death penalty in that case.
