SANTA FE — The New Mexico House is poised to consider a Senate-passed bill to allow judges to expunge some criminal records under certain circumstances.
The bill would allow a person to ask a court to expunge records. That could be done under certain circumstances by somebody arrested but not convicted.
Also, petitions could be filed by somebody convicted of a misdemeanor but not charged in other cases for at least five years, or 10 years for domestic violence offenders.
The Santa Fe New Mexican reports that people convicted of sex offenses, crimes against minors and drunken driving would not be allowed to request expungement.
Gov. Susana Martinez vetoed a version of the legislation last year.
The House Judiciary Committee approved the current bill Saturday.
