AG Refers Cousin's Case to Santa Fe DA

       LAS CRUCES — Attorney General Gary King's office has referred a case involving his cousin David King, an elected member of the Public Regulation Commission, to the District Attorney's Office in Santa Fe "in order to avoid any potential conflicts" of interest, according to a statement.
    The attorney general and PRC Commissioner David King are also partners in two real estate ventures, Pine Canyon Ranch Inc. and King Land and Cattle Co. The AG's office last month said King Land and Cattle was dissolved in about 2005, but this week Gary King said he was "apparently mistaken" and the partnership is still in effect, according to spokesman Phil Sisneros.
    On Aug. 28 the Public Regulation Commission's general counsel asked the attorney general to consider whether David King's bulk water sales to two water utilities violate state law. The utilities are regulated by the PRC. A state law covering the PRC says commissioners "shall not accept anything of value from a regulated entity."
    Sisneros said the decision to refer the matter to the Santa Fe District Attorney's Office was made by the chief deputy attorney general and that Gary King was not involved in the decision.
    David King has previously said his business dealings with two regulated water utilities did not violate state law, because water sales to utilities are not regulated by the PRC.
    David King is part-owner of Estancia Basin Water Supply, which for years has sold water to two utilities, New Mexico American Water Co. and Thunder Mountain Water Co., which serve customers in the Edgewood area.
