NM Appeals Court: Cities Have Final Say on Pay

      SANTA FE, N.M. (AP) — The New Mexico Court of Appeals says cities and counties have the final word on employee pay raises even when an arbitrator orders them.
    The court held that an arbitrator's award is binding as long as there is money available and the local government appropriates it.
    The ruling was issued in a case from Carlsbad. Firefighters sued after the city failed to appropriate money for a one-time, 15 percent pay increase awarded by an arbitrator in 2007. The state district court sided with the firefighters, and the city paid the money. But it also appealed the decision.
    Carlsbad says it will not try to recover the 15 percent.
