Elderly Las Cruces Man Won't Be Charged in Wife's Death

LAS CRUCES Prosecutors have decided not to charge an 87-year-old Las Cruces man with the death of his wife due to his mental health history.
Authorities have said that Drew Waldron shot his wife, 87-year-old Theria Waldron, once in the head with a handgun on March 28. Her body was found in the couple's bedroom of their upscale home.
District Attorney Susana Martinez said Wednesday her decision not to charge Waldron was based on information about his mental health that was obtained by prosecutors with the consent of family members.
Martinez said Waldron has Alzheimer's and dementia and legally cannot form the intent necessary to be charged with a crime.
Martinez said Waldron doesn't remember shooting his wife.
