Alamogordo Man Indicted in Killing

       ALAMOGORDO — An Otero County grand jury has indicted an Alamogordo man on a charge of first-degree murder after he was accused of killing his neighbor during an argument.
    The indictment also accused 49-year-old Timothy Wayne Hardegree of aggravated battery with a deadly weapon, aggravated assault with a deadly weapon and child abuse in the July 10 death of his neighbor, 33-year-old James Allen.
    District Attorney Scot Key says it's not a death penalty case.
    According to an affidavit filed by police, Allen was shot in the parking lot of a fourplex where he and Hardegree were neighbors.
    Witnesses say the gunman fired at Allen as he tried to crawl away and shot at people who tried to help him.
