Suspect Involved in Fight

By Vic Vela
Journal Staff Writer
An Española man who was shot to death over the weekend was killed by a man who had been involved in a fight with the victim's younger brother a week earlier, according to State Police.
Anthony Garcia was not involved in that altercation, but was shot four times in the chest by Jose Rizo nonetheless, State Police Lt. Eric Garcia said Wednesday.
Rizo, 31, faces an open count of murder and other charges after he allegedly shot Anthony Garcia outside a party in Española Friday.
Garcia, 56, arrived to the party that night inside a truck that another man was driving, but never had a chance to exit the vehicle before he was shot, the lieutenant said.
Rizo was inside the home when Garcia arrived and recognized him as the brother of the man he had fought with about a week earlier.
Lt. Garcia did not know the name of Anthony Garcia's brother or what that fight was all about.
Rizo ran out of the home with a handgun and confronted both Garcia and the driver of the truck. The suspect then shot Garcia and fled the scene, the lieutenant said.
Anthony Garcia died on his way to Española Hospital on Friday.
State Police had previously said that the victim was involved in the fight from a week ago. However, they clarified that on Wednesday, saying that was not the case.
It also appears that Garcia's death is not related to the recent murder of his son, Ivan Garcia, who was shot and killed at a Sonic Drive-In after a fight broke out there in August, according to the lieutenant.
Rizo was arrested without incident at a relative's home in Santa Fe about 5:30 p.m. Tuesday. He was taken to Santa Fe County jail and booked on an open count of murder as well as charges of shooting at or from a motor vehicle and possession of a firearm by a convicted felon.
