Court Upholds Ruling, Luevano Can’t Run

ALBUQUERQUE, N.M. — The state Supreme Court has upheld a District Court ruling that Johnny Luevano was ineligible to run for the House District 16 seat held by Antonio “Moe” Maestas.

Maestas challenged Luevano’s candidacy claiming he was not a district resident on the legally required date.

A judge in the District Court in Albuquerque ruled in Maestas’s favor. That led Bernalillo County Clerk Maggie Toulouse Oliver to remove Luevano’s name from the ballot.

Luevano then filed an appeal, claiming he was eligible to run because of a federal law that allows service members to establish a legal residency in a state while they are serving elsewhere.
