In dismissing the order, Presiding Family Court Judge Deborah Davis Walker said
Roybal Caballero didn’t prove that investigator Carlos Villanueva had “committed an incident of stalking.”
The two have had a long-running dispute that’s sometimes spilled into court.
In a petition earlier this year, Roybal Caballero accused Villanueva of stalking, harassing and threatening her, and a judge ordered him to stay away from her.
Villanueva, in turn, accused the lawmaker of retaliating against him because he’d filed an ethics complaint against her, and he said her allegations against him weren’t true.
Judge Davis Walker, whose courtroom is in Albuquerque, didn’t weigh in on any of that in the dismissal order. She simply noted that no stalking had been proven.
