ALBUQUERQUE, N.M. — Forgery, identity theft and embezzlement charges have been dismissed against a Texas woman accused of draining her mother’s bank account, canceling the lease to her apartment and giving her car away.
Judi Bivins’ case was dismissed in November 2016.
According to a spokesman for the Bernalillo County District Attorney’s Office, prosecutors made the decision to drop the case against Bivins, now 70, because “a good deal of the restitution was paid and the elderly victim broke her hip in Oklahoma, making travel for (pretrial interviews) and trial testimony problematic.”
Bivins’ attorney wrote in a court filing that Bivins had transferred the money and given away the car hoping to help her mother qualify for Medicaid. Her mother had been living in an apartment in Northeast Albuquerque.
