Man sues after slipping on green chile pod

SANTA FE – New Mexico green chile is known to sweep people off their feet.

Now, one man is suing a grocery store chain, saying he actually slipped and fell on a green chile pod two years ago.

Richard Berman claims he walked into the Sprouts on Zafarano Drive in Santa Fe in October 2016 “when he suddenly and without warning slipped on a green chile pod and fell,” a lawsuit filed Thursday in Santa Fe District Court says.

Berman is seeking damages for injuries he suffered to his neck, shoulder, back and left knee. He continues to suffer from headaches and pain, the suit says.

Berman says Sprouts “knew or should have known that the floor of the store, where the green chile was located, was subject to routine heavy foot traffic.”

“By failing to clean up the green chile that created a slip hazard in the presence of routine heavy foot traffic, without taking adequate precautions to prevent or warn visitors of such a slip hazard, Defendant breached its duty to exercise ordinary care,” the suit states.

A Sprouts Farmers Markets corporate spokesperson said the company does not comment on pending litigation.
