UPDATED: 22-Year Child Porn Sentence

ALBUQUERQUE, N.M. — Justin Gray, 33, of Ruidoso was sentenced Wednesday in U.S. District Court in Albuquerque to 22 years in prison for his conviction on federal child pornography charges, prosecutors said in a news release.

Gray’s time in prison will be followed by a lifetime of supervised release, and he will be required to register as a sex offender, the U.S. Attorney’s Office said.

Gray was charged in a six-count indictment on July 13, 2011, and was arrested on Sept. 12, 2011 and has been in federal custody ever since, according to the release. He pleaded guilty in July to a single count of receiving child pornography.

According to court records, before his arrest Gray had been convicted of criminal sexual contact with a minor in 2000 in Valencia County, criminal sexual penetration of a minor in 2000 in San Juan County, and sexual exploitation of children in 2009 in Santa Fe County.

A Ruidoso man arrested 10 months ago on federal child pornography charges will serve more than two decades in prison after pleading guilty Tuesday to a charge of receiving a visual depiction of a minor engaged in sexually explicit conduct, the Ruidoso News reported.

As part of a plea agreement, 34-year-old Justin Gray will serve 22 years in prison followed by a lifetime of supervised release and will be required to register as a sex offender, the News said.

Gray was indicted in July 2011 on three counts of distribution and attempted distribution of child pornography, one count of receiving sexually explicit images and two counts of possessing similar materials, the paper reported.

Gray has been in custody since his Sept. 12, 2011, arrest and will remain behind bars until he is sentenced on a date still to be determined, according to the News.

A Ruidoso man facing a six-count indictment charging him with child pornography offenses pleaded not guilty Wednesday during his arraignment in federal court in Albuquerque, the U.S. Attorney’s Office says.

Justin Gray, 33, waived a detention hearing and was ordered detained pending trial, according to a news release from the U.S. Attorney’s Office.

The news release said Gray is charged in the indictment with three counts of distribution and attempted distribution of visual depictions of minors engaged in sexually explicit conduct, one count of receipt of visual depiction of a minor engaged in sexually explicit conduct and two counts of possession of matter containing visual depictions of minors engaged in sexually explicit conduct.

The indictment alleges that Gray distributed child pornography in October 2010, November 2010 and February 2011; received child pornography in September 2010; and possessed child pornography in March 2011 — all in Lincoln County, according to the news release.

The news release said that if convicted of the charges in the indictment, Gray faces a prison sentence of not less than 15 years and not more than 30 years. He also would face a lifetime of supervised release after serving the prison sentence and would be required to register as a sex offender, according to the news release.
