FORECLOSURE SALE
Please Take Notice that the above-entitled Court, having duly appointed a Special Master in this matter with the power to sell, has ordered me to sell the property located at 312 Via Vista Street SE, Albuquerque, New Mexico 87123-5980, more fully described as:
- LOT NUMBERED TWENTY-NINE-P1 (29-P1) PLAT OF MIRAVISTA SUBDIVISION UNIT 1, (A REPLAT OF TRACT B-4 MANZANO MESA), ALBUQUERQUE, NEW MEXICO, AS THE SAME IS SHOWN AND DESIGNATED ON THE PLAT OF SAID SUBDIVISION, FILED IN THE OFFICE OF THE COUNTY CLERK OF BERNALILLO COUNTY, NEW MEXICO, ON JUNE 21, 2001, IN PLAT BOOK 2001C, FOLIO 173.
The property will be sold subject to rights of redemption; easements, reservations and restriction of records; taxes and governmental assessments; any liens or encumbrances not foreclosed in this proceeding; environmental contamination, if any, and zoning violations concerning the property, if any.
A Summary Judgment, Decree of Foreclosure, Default Judgment In Rem and Appointment of Special Master (the “Judgment”), was entered in the above captioned and numbered cause against the Defendants in favor of Wilmington Savings Fund Society, FSB as Owner Trustee of the Residential Credit Opportunities Trust V-C, on February 3, 2021, with Order on Motion to Amend Judgment entered on March 18, 2022, in the total amount of $220,452.90 plus interest at the rate specified in the Judgment from November 15, 2021. The sale is to begin at 9:45 A.M. on May 5, 2022, at the front steps of the Bernalillo County Courthouse, located at 400 Lomas Blvd NW, Albuquerque, New Mexico 87102, at which time I will sell to the highest bidder for cash the above-described Real Estate and all improvements thereon to pay the expenses of such Judgment referred to above, and to satisfy the total amount of the Judgment plus interest to the date of the foreclosure sale and the costs of the foreclosure sale. At such sale, the Plaintiff, Wilmington Savings Fund Society, FSB as Owner Trustee of the Residential Credit Opportunities Trust V-C, may become the purchaser of the property being sold, or part thereof, and may apply all or part of the Judgment to the bid, should it be the highest bidder.
