UPDATE: A missing 10-year-old boy was found Tuesday after an Amber Alert was issued for him and a 46-year-old woman he was with.

Santa Fe Police said the boy, James Agnew, was with Rebecca Aguirre, who is the fiancee of the child’s father but who in initial police reports Tuesday was said to not be the child’s mother or custodian.

As of 5 p.m. spokeswoman Celina Westervelt said the child was found with Aguirre, but that Aguirre was claiming she was the boy’s biological mother. No more information was available Tuesday afternoon.

The boy was last seen on Saturday. His father was worried for his son’s safety.

Westervelt said she didn’t know the circumstances that led to Aguirre leaving with the child. She said it would be up to the father or the circumstances of the case to determine whether Aguirre could face charges. The spokeswoman said police didn’t want Aguirre to be afraid to bring the child to them.

“We just want to make sure that the kid is safe,” Westervelt said prior to the child being found.


Santa Fe Police are searching for a 10-year-old boy who last was seen Saturday with his father’s fiancee.

James Agnew, who is about 4 feet tall and weighs 75 pounds, was last seen with Rebecca Aguirre, 46. James has hazel eyes and brown hair. Aguirre is about 5’1″, 110 pounds, with brown eyes and vibrant red hair. She is homeless and the two were together at a family shelter in Santa Fe.

She does not have custody of the child, and his father is worried for his son’s safety, according to police.

An Amber Alert has been issued to help locate the child. The pair may be headed to Albuquerque, or Rebecca also has ties to North Carolina, police said.
