UPDATED: Man Who Was Stationed at Kirtland AFB When Accused in Child Porn Case Gets 97 Months

ALBUQUERQUE, N.M. — A 25-year-old man who was an airman at Kirtland Air Force Base when he was arrested and charged with child pornography offenses earlier this year was sentenced Tuesday in federal court in Albuquerque to 97 months in prison followed by 30 years of supervised release, the U.S. Attorney’s Office said.

Shabaka Green also will be required to register as a sex offender when he completes his prison sentence, according to a news release from the U.S. Attorney’s Office.

U.S. Attorney Kenneth J. Gonzales said Green was an Air Force airman first class C3 stationed at Kirtland when he was arrested on Feb. 11 as a result of an undercover investigation conducted by the FBI.

The news release said the FBI obtained a search warrant for Green’s residence based on evidence obtained during the undercover investigation and executed a search warrant on Feb. 9.

Green, who has been in federal custody since his Feb. 11 arrest, was charged in a four-count indictment on March 9 with three counts of receipt of visual depictions of minors engaged in sexually explicit conduct and one count of possession of child pornography, according to the news release.

The news release said he pleaded guilty on May 23 to one count charging him with receipt of child pornography and the other three counts were dismissed Tuesday after he was sentenced.

In entering his guilty plea, Green acknowledged that a forensic examination of his computers and computer-related media uncovered thousands of image files and video files of child pornography, according to the news release.

A Kirtland Air Force Base airman pleaded guilty Monday in federal court in Albuquerque in a child pornography case.

The U.S. Attorney’s Office said in a news release that 25-year-old Shabaka Green faces a prison sentence of 5 years to 20 years to be followed by a lifetime of supervised release. He also will be required to register as a sex offender after he completes his prison sentence, according to the news release.

Green has been in federal custody since his arrest on Feb.11 and remains detained pending his sentencing hearing.

U.S. Attorney Kenneth J. Gonzales said Green was arrested on the base after evidence was developed during an undercover FBI investigation.

Green was charged in a four-count indictment with three counts of receipt of visual depictions of minors engaged in sexually explicit conduct and one count of possession of child pornography.

Prosecutors said Green entered a guilty plea under a plea agreement to count one of the indictment — a receipt of a visual depiction of a minor engaged in sexually explicit conduct charge — and the remaining counts will be dismissed after Green is sentenced.

Feb, 15, 2011 7:58 p.m. — Kirtland AFB Airman Facing Federal Child Porn Charges

An airman stationed at Kirtland Air Force Base was arrested last week and is charged in a criminal complaint with receipt, possession and distribution of child pornography, the U.S. Attorney’s Office announced Tuesday.

The agency said in a news release that Airman First Class C3 Shabaka Green, 25, appeared Tuesday (Feb. 15) in Albuquerque before Chief U.S. Magistrate Judge Richard L. Puglisi on the complaint and remains in federal custody pending a detention hearing scheduled for Wednesday (Feb. 16).

Green was arrested Friday (Feb. 11) at Kirtland AFB based on evidence developed during an FBI investigation in which it was determined that Green was the subscriber for an Internet Protocol (IP) address being used to download images and videos of minors involved in sexually explicit conduct (child pornography), according to the news release.

The news release said that if convicted of distribution and receipt of child pornography, Green faces a minimum 5-year to a maximum 20-year prison sentence, and if convicted of possession of child pornography, he faces up to 10 years imprisonment. Green also faces a life term of supervised release, a maximum fine of $250,000 and restitution as ordered by the court if convicted of any child pornography offense, according to the news release.
