Rio Rancho considering settlement of impact fee suit

RIO RANCHO — The City of Rio Rancho would pay $280,000 in damages under a proposed settlement agreement with Curb North Inc. in a lawsuit filed by the company in the wake of the city imposing a two-year moratorium on impact fees in 2012.

According to a story in the Rio Rancho Observer, the city and Curb reached agreement on Feb. 4, according to a briefing prepared by the city administration and city attorney’s office, which recommend approval at Wednesday’s Rio Rancho Governing Body meeting.

Curb North Inc., the developer of Cabezon, filed a lawsuit against the city in September 2012 shortly after the governing body approved a 24-month moratorium on residential impact fees and all of commercial impact fees. It sought $5.6 million in damages.
