Forest Service Sues N.M., Otero County

LAS CRUCES (AP) — The U.S. Forest Service has filed suit against the state and Otero County over management of certain forest lands. In 2001, the state passed a bill allowing counties to manage national forest lands under certain circumstances that Forest Service personnel couldn’t handle.

Otero County Commissioner Ronny Rardin tells the Alamogordo Daily News what the law does is allow local people within the Lincoln National Forest to manage the forest when the fire danger is up.

The U.S. attorney’s office said the United States Constitution forbids New Mexico and Otero County from supplanting the federal government’s land and fire management regime with its own state and county-specific policies.
