Albuquerque man charged in rape of teenage boy

A man is accused of raping a teenage boy earlier this month at a home in Northwest Albuquerque.

Dominic Martinez, 51, is charged with two counts of criminal sexual penetration and one count of criminal sexual contact of a minor.

Martinez is accused of raping a 15-year-old boy on Feb. 2. The boy told police he “went along with it” but, due to his age, the case is considered statutory rape.

Martinez has been booked into the Metropolitan Detention Center, and his attorney could not be reached Saturday.

All 2nd Judicial District Court judges are recused from the case, according to a court order filed Thursday, as the boy who was raped is “a current court employee’s immediate family member.”

The state Supreme Court chose 1st Judicial District Court Judge Glenn Ellington in Santa Fe to preside over the case.

Albuquerque Police Department spokeswoman Franchesca Perdue said there may be other victims.

“Since his arrest, APD Sex Crimes Unit has been made aware of, and are actively investigating other sexual assaults that may be connected to Martinez,” she said. “The Albuquerque Police Department would like to remind the community that there are multiple ways to report sexual assault, even in instances of delayed reporting.”

Perdue said victims can report by calling (505) 242-COPS, the Family Advocacy Center at (505) 243-2333 and the Rape Crisis Center at (505) 266-7711.

Meanwhile, prosecutors have filed a motion to detain Martinez until trial, saying his “sexual appetite for children puts the community, and particularly children, at risk.”

Police responded on Feb. 2 to the teenager’s home in Northwest Albuquerque after he told a relative that Martinez raped him, according to a criminal complaint filed in Metropolitan Court. The boy told police he was watching a movie with another teen at Martinez’s home when the man touched his leg, making him “confused.”

Police said the boy told them he “went along with it” and the two went upstairs, where Martinez raped him, telling him “good job champ” afterward. The boy said he told his mother when he got home and she called 911.

On Feb. 3, officers searched Martinez’s home, also in Northwest Albuquerque, and took DNA swabs, according to the complaint. Martinez sat down with police and, initially, was “cooperative and cried.”

Police said Martinez told them he had “his side of the story” and wanted it to “be received in the right way” before asking for an attorney. Officers took DNA swabs from Martinez and the teen.
