BCSO identifes man fatally shot by deputies

Man killed by deputies had no criminal history after 2016

The Bernalillo County Sheriff's Office on Monday identified the man shot and killed by deputies on Dec. 16.

Marc Dutch, 42, was shot by deputies during a federal crime-fighting operation — named Operation Triple Beam — in Albuquerque's International District. He was pronounced dead on the scene, according to a news release from Jayme Gonzales, spokesperson for BCSO.

BCSO did not say if Dutch was armed or what led deputies to open fire. The shooting was the second time deputies have shot, or shot at, someone since the operation started in early November and the first fatality. 

In a news release, BCSO said Dutch had a "significant criminal history" that included felony charges of aggravated assault with a deadly weapon, kidnapping, embezzlement of a motor vehicle, burglary and a felon in possession of a firearm. 

Those charges stem from cases in 2004, 2013 and 2016. Court records show prosecutors dismissed the kidnapping charge in November 2023 and the felon in possession of a firearm charge in February 2016. 

Before being shot by deputies, Dutch was riding on a motorcycle on Dec. 16 when he was pulled over around 6 p.m. in the 300 block of Virginia NE, just southwest of Wyoming and Copper. 

Gonzales did not elaborate on why deputies pulled Dutch over, but did say it was part of an auto theft segment of Operation Triple Beam. 

At some point, Dutch fled on foot, Gonzales said. Deputies created a perimeter with assistance from a BSCO helicopter and sometime later, deputies "reengaged the individual" near the 300 block of Wisconsin SE, near Wyoming and Zuni.

She said "during the encounter" at least one deputy fired at Dutch and killed him. It is unknown how many deputies opened fire or how many shots were fired.
