Bernalillo County Sheriff's Office identifies 35-year-old fatally shot by deputies

The Bernalillo County Sheriff’s Office identified the man shot and killed by deputies on Thursday morning in a Sandia foothills neighborhood.

Deputy Deanna Aragon, a BCSO spokesperson, said Brian Padilla, 36, was pronounced dead at the scene. No deputies were injured in the incident.

BCSO said previously that Padilla was armed prior to the encounter but has not said what the weapon was, if Padilla used the weapon, or what led deputies to shoot him. Outside identifying Padilla, no further details have been released about the incident.

Court records show Padilla had no criminal history before a recent DWI arrest after he was in a rollover crash in late December. Padilla was sentenced to probation in the case.

Padilla’s family could not be reached Saturday.

Around 4 a.m. Thursday, BCSO responded to reports of a “disturbance” at a home in the 500 block of Live Oak NE, in a neighborhood to the east of Tramway and Paseo del Norte.

BCSO said the 911 caller stayed on the phone with dispatch and reported the man causing the disturbance “was becoming violent and was arming himself.” Arriving deputies approached Padilla, who was at the home, and “almost immediately a confrontation occurred,” the agency said.

BCSO said “at least one” deputy shot at Padilla, striking him.

The Multi-Agency Task Force was called to investigate the shooting.
