Jury acquits man of murder in 2021 shooting death

A jury this week acquitted a man of murder charges in the 2021 shooting death of 41-year-old Michael McCoy at a Southeast Albuquerque apartment complex.

Jurors on Thursday found Brandon Holloman, 30, not guilty of first-degree murder and a lesser included charge of second-degree murder in McCoy’s death.

But jurors failed to reach a verdict on charges of voluntary manslaughter and tampering with evidence, the 2nd Judicial District Attorney’s Office said Friday.

State District Judge Stan Whitaker scheduled a hearing on Tuesday to discuss Holloman’s conditions of release.

Holloman’s attorney, John McCall, did not immediately return a phone message Friday seeking comment.

Albuquerque police responded March 30, 2021, to a shooting at an apartment complex at 1000 Louisiana SE, just north of Gibson. Officers found McCoy’s wife standing over his body.

A neighbor told police two men came out of the wife’s apartment and began arguing with McCoy when he arrived at the complex, according to court records.

He said one of the men shot McCoy in the head before the pair rifled through his pockets and fled in separate directions.

The wife told police they were in the middle of a divorce and McCoy wanted to reconcile, according to court records. She said she rejected him and he became upset before she hung up on him.

Police said the wife told them McCoy called back and became upset when he overheard a friend of hers talking in the background.

The wife told police McCoy arrived and began yelling at her friends. She said one of the men shot McCoy and then both fled the scene.
