Teen shot on ABQ West Side dies from injuries. Alleged shooter could face new charges.

A 16-year-old boy shot during a fight on Albuquerque’s West Side last month has died, according to police.

In a news release sent over the weekend, the Albuquerque Police Department said detectives were told that Joshua Torres died Thursday — 10 days after he was shot in the eye, allegedly by 20-year-old Daniel Mayorga.

Officers arrested Mayorga following the shooting, and he was charged with aggravated battery with a deadly weapon resulting in great bodily harm, tampering with evidence and unlawful carrying of a deadly weapon. Those charges, in consultation with the District Attorney’s Office, will be revised, APD said in the release.

The fight happened as teens were hanging out around 1:30 p.m. on July 21 in an area known as “The View,” near Kimmick and Valiente NW, south of Paseo del Norte, according to the release.

“Mayorga got upset with one of the boys in the other group and shoved him. Torres stepped in, exchanged words with Mayorga, who shoved Torres,” the release said, citing witness accounts. “Torres punched Mayorga, who then produced a handgun and shot Torres in the eye.”

Mayorga told detectives he was drinking and smoking marijuana with friends when a fight started, but he denied being involved. He said he heard a gunshot, but he wasn’t the shooter, according to police.
